BCN friends:

The American Bird Conservancy (ABC) continues to be the national leader in
important efforts to conserve our wild birds.  Here is a summary of just a
few of the main issues from last week’s board meeting.

Endangered Species Protection (ESA)

Secretary of Interior Norton has proposed an amendment to the ESA that would
allow the  Environmental Protection Agency (EPA) to eliminate the
requirement for federal agencies to consult with wildlife experts at USF&W
and National Marine Fisheries Service when pesticides are up for
registration or review.  This means that if a pesticide may adversely affect
Piping Plovers, for example, that the EPA could allow its use without
consulting with the agencies most qualified to evaluate the threat. ABC’s
Vice-President for Pesticides and Birds, Dr. Patti Bright, gave strong
testimony opposing this proposal.

Reforming Migratory Bird Treaty Act (MBTA)

Because of a federal appeals court decision that extended the MBTA to
protect non-native birds, H.R. 4114 and a companion bill in the Senate were
introduced.  ABC testified in favor of these bills, the purpose of which is
to make clear that alien species such as Mute Swans, European Starlings,
etc., don’t have the protection are native species do.  Thousands of Mute
Swans have caused significant environmental damage in Chesapeake Bay and
elsewhere.  These bills also increase authorized funding for the Neotropical
Migratory Bird Conservation Act (NMBCA).

ABC to Sue Federal Communications Commission (FCC) Over Tower Kills

ABC and Forest Conservation Council notified the FCC that a lawsuit would be
filed to prevent the killing of as many as 50 million birds each year at
communication towers.  Birds are attracted to the artificial lights, which
they circle confused, until they strike the tower or surrounding guy wires
or become exhausted and fall to the ground where vehicles and predators kill
them.

Proposal to Shift Migratory Bird Management to Agriculture Department

H.R. 3320 has been introduced on behalf of agriculture and aquaculture
interests, to strip authority for the incidental take of migratory birds
from USF&W to the Department of Agriculture’s Wildlife Services (WS).  This
legislation further proposes elimination of public review of actions by WS
by exempting WS from the National Environmental Policy Act (NEPA).  WS has
been killing thousands of birds across the country under existing USF&W
permits and the passage of this legislation will increase this, regardless
of scientific evidence to the contrary.  ABC will be testifying against this
bill at forthcoming hearings.

Mountain Top Mining Threatens Cerulean Warblers

Gerald Winegrad, ABC’s Vice-President for Policy, testified on behalf of 50
environmental groups   in opposition to a proposal by the Interior
Department to destroy 380,000 acres of deciduous woodland in the Appalachian
Mountains.  The administration wants to allow the practice of removing
mountaintops and dumping the removed portions in nearby valleys and streams
to extract otherwise hard to reach coal.  Declining Cerulean Warblers would
be particularly hard hit and an expected 137,000 birds are expected to be
lost in the next decade.
