but it is still very positive news on this important issue - which had been
looking bleak.

Dear Birding and Wildlife-watching Friends,
You might not have heard about what the Senate passed on Thursday night (20
Dec), S. 990, the "American Wildlife Enhancement Act of 2001." It passed the
Senate without a single amendment by unanimous consent.
The heart of the bill is very much like Title III of CARA, but without
guaranteed long-term funding. (It does provide authorization for $350
million to the Wildlife Conservation and Restoration Program to go to the
states for wildlife work. That amount is equal to what CARA calls for...)
This move is very important. Yes, S. 990 is more than a stocking-stuffer
for Christmas. It pushes the wildlife issue in the right direction, and it
helps to illustrate that wildlife conservation is not simply bi-partisan;
it is virtually non-partisan.
However, S. 990 does not solve the long-term funding problem confronting
those species (mostly non-game) at risk, but it can
serve as a crucial bridge to that goal.
Here's a quick summary:
Title I authorizes an appropriation of $350 million annually for vitally
needed state fish and wildlife conservation and related recreation and
education programs. The funds will be available to each state and territory
through a sub-account of the Pittman-Robertson Act. (The title includes the
important "strategy language" that, "based on the best available and
appropriate scientific information," the states have to identify the species
in need of help and prioritize the actions necessary for the maintenance of
healthy populations. Public participation is also included. This is all very
good for the birds that interest most of us.)
Title II amends the Endangered Species Act (ESA) and establishes a
competitive matching grant fund of $50 million annually that allows private
(small) landowners to apply for financial assistance for conservation of
endangered or threatened species on their property.
Title III establishes a grants program of $59 million annually that would
allow states to pay the Federal share of the costs of conservation of
non-Federal land or water of significance. It protects areas of regional or
national significance through easements or acquisition.
Title IV establishes a $50 million annual fund for the conservation of
shrubland and grassland (for prescribed burns, restoration of riparian
habitat, elimination of invasives/exotics, re-seeding of native grasses,
etc). Applications can be in addition to other programs (e.g., CRP of Farm
Bill).

Here are the limitations or problems with S. 990?
Most importantly, there is no guaranteed long-term funding. (It provides
authorization, not appropriation, for $350 million. Linking the broader CARA
to the offshore revenue source had been a way to resolve this.
Besides, some of us loved the irony of "re-cycling" those funds from
non-renewable to renewable resources. Of course, offshore oil and gas was
also an issue which kept certain green groups away from CARA...)
There apparently is an unfortunate 10% cap on wildlife-associated
recreation. (But at least it's "waveable" with a process to get it lifted
for certain important projects. [See Title I, Sec 12 (5)(D)(ii)]) If there
were more individuals and groups explaining to the-powers-that-be that
wildlife-associated recreation is KEY to creating and sustaining a
bird-and-wildlife conservation constituency into the future, we'd be better
off. P.S.: So would the birds.
Unlike CARA, S. 990 does not include the Land and Water Conservation Fund.
(That's because it's not intended to include LWCF. LWCF is ALREADY on the
books and must fight for appropriations. Part of the intent of S. 990 was to
get the Senate to say that a wildlife bill to enhance Pittman-Robertson's
limited coverage was essential.)
What does this mean for CARA? Well, passage of S. 990 can join in the
mix, pushing Congress closer to wildlife and comprehensive conservation
funding. At the same time, the House will have to move with the passage of
something important here -- either CARA (H.R. 701 with it's pre-9/11
co-sponsors adding up 243 members) -- or the passage of some other wildlife
legislation by both houses of Congress. Finally, we may be able to get
something significant out of a Senate/House conference.
That's the scene as we approach the end of a unique and troubling year.
It's the scene that birding and wildlife-watching folks – who want more
funding for our resources – will face, come 2002.
