Hi BCN friends-

Less than a month ago I informed you about the efforts of American Bird
Conservancy (ABC) along with other organizations in fighting animal rights
extremists that have been attempting to stop the poisonings of rats on
Anacapa Island off the California Coast.  On Thursday a Federal court gave
permission for the eradication project to proceed.  Here are the details:

The Federal District Court in DC ruled at 4 p.m. Thursday that the NPS rat
eradication project on Anacapa Island can go forward as planned.  ABC aided
the NPS and Justice Dept. by sending in a supportive letter and gaining ltrs
of support from the PSG and Bill Everett's ESRC.   The ruling was after a
lengthy court hearing on Tuesday.  The opinion is 30 pages long and the NPS
and contractors are held up right now by rain (effecting the bait pellets if
they were dropped) and vegetative growth.  They will meet on Monday to
decide when to drop the brodifacoum laced pellets by helicopter.  This case
is significant beyond Anacapa as plans are afoot to eradicate introduced
predators on other Channel Islands and islands such as Guadeloupe off the
Baja Coast.  Bernie Tershy has contracts and co-operation from the U.S. and
Mexican governments on these other projects. The Anacapa rat eradication
effort will lead to increases in the breeding population of Xantus's
Murrelet and possibly the Ashy Storm-petrel.

will be able to get the bait out by mid Dec.
