Now for the bad news. Apparently I did not have my facts quite straight, and the "Letter of Permission" process IS the appropriate procedure for the USACE to follow in a project of his nature. It is true that this project does not require a 404 Clean Water Act permit. There will be no discharge of fill associated with this project. The permit application for the marina requests a permit under Section 10 of the Rivers and Harbors Act of 1899. This act states: "the creation of any obstruction not affirmatively authorized by Congress, to the navigable capacity of any of the waters of the United States is hereby prohibited; and it shall not be lawful to build or commence the building of any wharf, pier, dolphin, boom, weir, breakwater, bulkhead, jetty, or other structures in any port, roadstead, haven, harbor, canal, navigable river, or other water of the United States, outside established harbor lines, or where no harbor lines have been established, except on plans recommended by the Chief of Engineers and authorized by the Secretary of War; and it shall not be lawful to excavate or fill, or in any manner to alter or modify the course, location, condition, or capacity of, any port, roadstead, haven, harbor, canal, lake, harbor of refuge, or inclosure within the limits of any breakwater, or of the channel of any navigable water of the United States, unless the work has been recommended by the Chief of Engineers and authorized by the Secretary of War prior to beginning the same." In short, you cannot build a marina in the waters of the United States, including Lake Calumet, without the approval of the Army Corps or Congress. The Illinois International Port District is requesting a Letter of Permission from the Corps that would allow construction of the marina. As Mr. Marcisz correctly pointed out in his first email, this process can only be used if "proposed work...would not have significant individual & cumulative impacts on environmental values, and should encounter no appreciable opposition." That quote is from the U.S. Code of Federal Regulations and is written specifically about Section 10 of the Rivers and Harbors Act. It appears that this project will have significant impacts on environmental values and that there is appreciable opposition to the project, judging by the number of phone calls the Corps is receiving. The Corps cannot just use the Letter of Permission process whenever they want to-an accurate assessment of environmental impact and public opposition is expected. The alternative way for the Port District to apply for a permit is to file a regular application which is subject to a regular public comment period. Given that the requirements for the Letter of Permission process do not appear to be fulfilled, I believe the Corps is acting inappropriately by using this process. A regular permit application should be required and the public should have every opportunity to comment. My feeling right now is that this project is not a "done deal." As far as what we can do, calls letting the Corps know that there is appreciable opposition to this permit from a variety of groups will continue to document that the Letter of Permission action is being applied incorrectly. I had heard that Senator Dick Durbin's office had gotten involved in this issue, but I don't know to what extent. A call to his office asking why the Corps is being allowed to use an invalid permitting method to the detriment of Illinois waters can't hurt. EIGHT YEAR OLD WINS = POSTER COMPETITION FOR FOURTH NATIONAL KEEP YOUR CAT INDOORS = DAY

 

WASHINGTON, DC: American Bird = Conservancy (ABC) and Wild Bird Centers of America (WBCA) announce the winners of = the children’s poster competition for the fourth annual National Keep = Your Cat Indoors Day on May 11, 2002. The posters help to publicize the event = which aims to educate cat owners that cats, birds and other wildlife all benefit = when cats are kept indoors. The event coincides with International Migratory Bird = Day (IMBD) which involves thousands of people in birdwatching and education activities across the country during the spring bird = migration.


Linda Winter, Director of Cats Indoors! Campaign for ABC stated, = "Once again, it was a hard choice. We received so many excellent posters from children all across the country showing happy indoor cats." The = overall winner and winner in the age 8 - 9 category is Lillian Chen from Cedar = Knolls, NJ. Lillian is 8 years old and attends the Mountview Road School. = Lillian wins a $200 gift certificate from WBCA, and a $150 gift certificate for her = school, Mountview Road School. The winner of the 10 - 12 age category is Holly = Popp from Salem, OH, and the winner in the 6 - 7 age category is Mike Eidem = from Horicon, WI. They each receive a $100 gift certificate. George Petrides, president of Wild Bird Centers of America, said, "Congratulations and thanks to all the children who sent such = wonderful artwork for this contest. It is encouraging that so many young people = are interested in the future of our bird populations and maintaining the = health and safety of our domestic pets."

 

Each year, free-roaming domestic = cats kill hundreds of millions of birds and small mammals, some of which are = rare species in danger of extinction. In addition, millions of outdoor cats = are killed or injured by cars or in fights with other cats, dogs, or wild = animals. Free-roaming cats can contract debilitating and life-threatening = diseases, become lost, stolen, or poisoned. It is clearly in the best interest of = both cats and birds to keep cats at home.


ABC’s Cats Indoors! Campaign is supported by thousands of = individuals and conservation, animal welfare, wildlife rehabilitation, and veterinary organizations throughout the country including The Humane Society of the = United States, American Humane Association, New Jersey Audubon Society, and the International Wildlife Rehabilitation Council. ABC produces campaign = education materials which include a color brochure and poster. Fact sheets on cat predation on birds and other wildlife, hazards to free-roaming cats, cat ordinances, and how to make an outdoor cat a content indoor pet are also available, as well as Public Service Announcements and a teacher’s = activity guide for grades K - 6. If the permit is issued, I do not yet know of any process by which we could
appeal the decision to the Corps, but I am looking into it.  Other than
that, litigation would be an option, but as everyone knows, this is
time-consuming, expensive, and generally not the most desirable way to solve

The Alderman only supports dog use of Montrose Beach during the winter off-season from November to March, the same position taken by the city-based bird clubs and the BCN and its other member clubs. You'll see that from the letter to the dog owners, below, that her aide asked me to post up to IBET. I clarified with Maggie Marystone that "off-season" means "winter." Since shorebirds are not present during the winter, the bird clubs are not opposed to dogs using the beach then. During migration, dogs should not be present on the beach. Note that Alderman Shiller put a further caveat on dog use at Montrose Beach - that it be temporary. As 46th Ward residents, Geoff Williamson, Bob Hughes and I met Alderman Shiller last year to present the birders' position about dogs on Montrose Beach. We are all very pleased that she accepted our advice on this issue and was responsive to her constituents and the wider birding community. Our understanding of the city's dog beach ordinance is that if the Alderman does not agree to dog beach status, it will not happen. After so many calls and emails (Alderman Shiller's aide said she received too many emails to count), we hope that the Chicago Park District will drop its proposal for evening summer hours for dog use on Montrose Beach and permit dogs to be present only during the winter.. Location: The Alfred Caldwell Lily Pool is located south of Fullerton Avenue, directly north of the Lincoln Park Zoo. There is a north entrance on Fullerton Avenue and a handicapped accessible entrance on the east side off the Cannon Drive parking lot. Why does the Lily Pool need monitors? The CPD and FLP have recently spent $2.4 million on the restoration of the lily pool. Years of trampling, neglect and abuse severely degraded the site and its historic features until it no longer resembled its former character. Restoration of the site has included restored historic features such as the pavilion, waterfalls, and stone work including a council ring; new accessible pathways; and ecological restoration of the landscape. Because this site is sensitive and gets a high amount of use, visitor hours will be limited (see below). Monitoring is desired during these hours to preserve this historic landscape and keep it beautiful. Volunteer schedule: The tentative visiting hours for the lily pool are: Monday through Friday from 7:30AM to 3:00PM and Saturday and Sunday from 10:00AM to 3:00PM. Both gates will be locked except at these times. Many of these hours are currently covered by Chicago Park District summer interns or Lincoln Park Zoo security staff on weekends (thanks to FLP); however, many hours remain unfilled by staff, security, or volunteers. The landscape design of the Caldwell Lily Pool is a tribute to the natural ecology of the Midwest. It was originally designed to mimic a river formed by a melting glacier's flow of water cutting through limestone. The stonework and paths have a natural look that conveys the interpretation that melted glacial water flows are cutting through moraines, creating dramatic limestone bluffs. With these new improvements, the Lily Pool landscape is again becoming a haven for wildlife, providing food, water, and shelter for many species of birds, dragonflies, butterflies, frogs, and turtles. Dann Highland Park/Lake County In what could become the nation's biggest wetlands restoration outside the Florida Everglades, an agricultural company has agreed to sell 16,500 acres of salt ponds around San Francisco Bay, an area twice the size of San Francisco. Returning the ponds to tidal wetlands would vastly increase the amount of public shoreline in the South Bay and provide enlarged quarters for millions of waterfowl and shorebirds that live here or visit on migratory routes, officials said Tuesday. Environmentalists have called the acquisition the crown jewel in a 10-year campaign to restore tidal marsh in a bay that has lost 80 percent to development. The state and federal governments and private foundations signed a preliminary agreement Tuesday. The deal, brokered by Sen. Dianne Feinstein, offers $100 million to Cargill Inc., an international agricultural and food company. A purchase agreement is to be signed Sept. 16, and $53 million will be paid at a Nov. 16 closing, with the remainder due over five years. The ponds -- shimmering chartreuse to orange-red checkerboards on display for millions of travelers whose planes land here -- lie along the shorelines of Alameda, Santa Clara and San Mateo counties. Cargill also is selling 1,400 acres of ponds in Napa County on the Napa River. "We're taking the first step toward restoring the San Francisco Bay for the people of California," Gov. Gray Davis said Tuesday. "This is more than just a purchase. Today we're making a commitment -- to enhance our communities, our state and our most precious natural resources," Davis said. MONEY AVAILABLE Two years ago, the governor signed a bill by then Assemblywoman Carole Migden committing $25 million to get the project rolling. The federal government has authorized $8 million. Another $35 million will come from the William and Flora Hewlett Foundation, the David and Lucile Packard Foundation, the Gordon and Betty Moore Foundation and the Richard and Rhoda Goldman Fund. The remainder of the money -- $32 million -- will come from state water and park bonds passed by voters through state Coastal Conservancy, the San Francisco Bay Conservancy and the state Wildlife Conservation Fund. "The Everglades in Florida is the largest wetland restoration in the country, and this is the largest shoreline restoration that increases tidal wetlands," said California Resources Secretary Mary Nichols. "For the people who live around San Francisco Bay, this is an opportunity to improve open space forever and ever and create opportunities for recreation and education adjacent to one of the most concentrated urban areas in the country," Nichols said. 80 PERCENT OF WETLANDS LOST The bay has lost 80 percent of its original 190,000 acres of tidal marshes to diking and filling over the past 150 years. For 40 years, local environmentalists have envisioned returning the commercial ponds in the southern bay to working wetlands, once again serving as habitat for wildlife, filters for pollutants, flood control and open space for hiking and watching birds. Over the years, they lobbied in Congress to increase the size of the Don Edwards San Francisco Bay National Wildlife Refuge. Now, the Cargill ponds can be folded in with no further congressional approval. The state will manage 7,000 acres of the ponds as a wildlife reserve. Many environmentalists were happy about the deal. "Sen. Feinstein and the agencies have hit a home run for the bay. And California voters have been willing to vote billions of dollars for environmental projects. It proves that we don't need to destroy other parts of the bay in order to reclaim tidal wetlands. That's what the airport has been trying to convince people," said David Lewis, executive director of Save San Francisco Bay. BAD EXPERIENCE WITH CARGILL Florence LaRiviere, a founder of the Citizens Committee to Complete the Refuge, said her group is cautious. The environmentalists had a bad experience with Cargill in 1994 when the company sold land to the state but left behind bittern, a highly saline waste, and no money to clean it up, she said. "Our vision is that things will be done right this time," said LaRiviere. Early Native Americans who lived around the bay extracted salt from diked ponds. Leslie Salt Co. came to the bay in the 1930s, expanding over time and selling to Cargill in 1978. Cargill will retain 11,000 acres around the bay -- 3,000 acres that it owns outright and 8,000 acres where it owns salt-extraction rights on refuge land. SUSTAINABLE SALT BUSINESS "Our goal was to have a strong, sustainable salt business for the foreseeable future -- 40 or 50 years, who knows," said Lori Johnson, spokeswoman for Cargill. "The acquisition is based on land we no longer need for salt production that could be restored to tidal marsh or other uses." Cargill plans to keep producing 650 tons of salt a year and continue to employ 200 employees and 70 part-time workers at its Newark plant. Cargill isn't selling 1,400 acres around its Redwood City plant or the nearby 800-acre pond. Under the agreement, Cargill will lower the salinity of the ponds to standards set forth in a permit that will be issued by the San Francisco Bay Regional Water Quality Control Board. The company can't sell the land until it meets the permit requirements. Currently, there's no appropriation in the 2002 federal budget for extra money to maintain and operate dikes and pumping of the pond. Congress would have to approve funds for the refuge above the president's budget. Interior Secretary Gale Norton has already expressed support for the agreement. Her spokesman, Eric Ruff, director of communications, said Tuesday that "the secretary believes that this kind of agreement, which brings together federal and state governments, working in cooperation with local cities and organizations, represents the strength of conservation." BIG JOB AHEAD Once the refuge takes over the land, years of restoration lie ahead. Scientists have estimated a range of $200 million up to $1 billion, depending on how much is restored to tidal marsh. Scientists envision a diverse mix of tidal marshes and fresh water seasonal wetlands to upland habitat. Feinstein, who put the deal together just as she did the purchase of the Headwaters Preserve, said: "I've tried to take individual projects, including the California Desert Protection Act and the Lake Tahoe agreement, and follow through to the end.    In what could become the nation's biggest = wetlands restoration

outside the Florida Everglades, = an agricultural company has agreed to=

sell 16,500 acres of salt ponds = around San Francisco Bay, an area twice=

the size of San = Francisco.

   Returning the ponds to tidal wetlands would = vastly increase the

amount of public shoreline in the = South Bay and provide enlarged

quarters for millions of = waterfowl and shorebirds that live here or=

visit on migratory routes, = officials said Tuesday.

   Environmentalists have called the acquisition = the crown jewel in a

10-year campaign to restore tidal = marsh in a bay that has lost 80=

percent to = development.

   The state and = federal governments and private foundations signed a=

preliminary agreement Tuesday. = The deal, brokered by Sen. Dianne

Feinstein, offers $100 million to Cargill Inc., an international=

agricultural and food = company.

   A purchase agreement is to be signed Sept. 16, = and $53 million will

be paid at a Nov. 16 closing, = with the remainder due over five years.=

   The ponds -- shimmering chartreuse to = orange-red checkerboards on

display for millions of travelers = whose planes land here -- lie along=

the shorelines of Alameda, Santa = Clara and San Mateo counties. Cargill=

also is selling 1,400 acres of = ponds in Napa County on the Napa River.=

   "We're taking the first step toward = restoring the San Francisco Bay

for the people of = California," Gov. Gray Davis said Tuesday.

   "This is more than just a purchase. Today = we're making a commitment

-- to enhance our communities, = our state and our most precious natural=

resources," Davis = said.

   MONEY AVAILABLE=

   Two years ago, the governor signed a bill by = then Assemblywoman

Carole Migden committing $25 = million to get the project rolling.

   The federal government has authorized $8 = million. Another $35 million

will come from the William and = Flora Hewlett Foundation, the David and=

Lucile Packard Foundation, the = Gordon and Betty Moore Foundation and the=

Richard and Rhoda Goldman = Fund.

   The remainder of the money -- $32 million -- = will come from state

water and park bonds passed by = voters through state Coastal Conservancy,=

the San Francisco Bay Conservancy = and the state Wildlife Conservation=

Fund.=

   "The Everglades in Florida is the largest = wetland restoration in the

country, and this is the largest shoreline restoration that increases=

tidal wetlands," said = California Resources Secretary Mary Nichols.=

   "For the people who live around San = Francisco Bay, this is an

opportunity to improve open space forever and ever and create=

opportunities for recreation and education adjacent to one of the most=

concentrated urban areas in the = country," Nichols said.

   80 PERCENT OF WETLANDS LOST

   The bay has lost 80 percent of its original = 190,000 acres of tidal

marshes to diking and filling = over the past 150 years.

   For 40 years, local environmentalists have = envisioned returning the

commercial ponds in the southern = bay to working wetlands, once again=

serving as habitat for wildlife, = filters for pollutants, flood control=

and open space for hiking and = watching birds. Over the years, they=

lobbied in Congress to increase = the size of the Don Edwards San

Francisco Bay National Wildlife = Refuge. Now, the Cargill ponds can be=

folded in with no further = congressional approval. The state will manage=

7,000 acres of the ponds as a = wildlife reserve.

   Many environmentalists were happy about the = deal.

   "Sen. Feinstein and the agencies have hit = a home run for the bay. And

California voters have been = willing to vote billions of dollars for=

environmental projects. It proves = that we don't need to destroy other=

parts of the bay in order to = reclaim tidal wetlands. That's what the=

airport has been trying to = convince people," said David Lewis, executive=

director of Save San Francisco = Bay.

   BAD EXPERIENCE WITH CARGILL

   Florence LaRiviere, a founder of the Citizens Committee to Complete

the Refuge, said her group is = cautious. The environmentalists had a bad=

experience with Cargill in 1994 = when the company sold land to the state=

but left behind bittern, a highly = saline waste, and no money to clean it=

up, she said.

   "Our vision is that things will be done = right this time," said

LaRiviere.

   Early Native Americans who lived around the bay extracted salt from

diked ponds. Leslie Salt Co. came = to the bay in the 1930s, expanding=

over time and selling to Cargill = in 1978.

   Cargill will retain 11,000 acres around the bay = -- 3,000 acres that

it owns outright and 8,000 acres = where it owns salt-extraction rights on=

refuge land.

   SUSTAINABLE SALT BUSINESS

   "Our goal was to have a strong, = sustainable salt business for the

foreseeable future -- 40 or 50 = years, who knows," said Lori Johnson,=

spokeswoman for Cargill. = "The acquisition is based on land we no longer=

need for salt production that = could be restored to tidal marsh or other=

uses."

   Cargill plans to keep producing 650 tons of = salt a year and continue

to employ 200 employees and 70 = part-time workers at its Newark plant.=

   Cargill isn't selling 1,400 acres around its = Redwood City plant or

the nearby 800-acre = pond.

   Under the agreement, Cargill will lower the = salinity of the ponds to

standards set forth in a permit = that will be issued by the San Francisco=

Bay Regional Water Quality = Control Board. The company can't sell the=

land until it meets the permit requirements.

   Currently, there's no appropriation in the 2002 federal budget for

extra money to maintain and = operate dikes and pumping of the pond.=

Congress would have to approve = funds for the refuge above the

president's = budget.

   Interior Secretary Gale Norton has already = expressed support for the

agreement. Her spokesman, Eric = Ruff, director of communications, said=

Tuesday that "the secretary believes that this kind of agreement, which=

brings together federal and state governments, working in cooperation=

with local cities and = organizations, represents the strength of=

conservation."<= font color=3Dblack>

   BIG JOB AHEAD=

   Once the refuge takes over the land, years of restoration lie ahead.

Scientists have estimated a range = of $200 million up to $1 billion,=

depending on how much is restored = to tidal marsh. Scientists envision a=

diverse mix of tidal marshes and = fresh water seasonal wetlands to upland=

habitat.=

   Feinstein, who put the deal together just as = she did the purchase of

the Headwaters Preserve, said: "I've tried to take individual projects,=

including the California Desert Protection Act and the Lake Tahoe=

agreement, and follow through to = the end. In that way, it becomes=

something living, real and = exciting as opposed to legislation."=
